Welcome to the EK 290mm Fender Competition (the "Competition"). By entering your product design or voting in this Competition, you expressly agree to be bound by these Terms and Conditions of Entry (the "Terms"). Please review them carefully before participating.

1. The Promoter & Funding

The promoter of this Competition is Piyesa Hub Pty Ltd (ABN 64 664 270 982) ("the Promoter"), registered in Australia. The Competition is entirely funded and operated by the Promoter, with no external corporate sponsors, brand partnerships, or third-party endorsements.

2. Eligibility

  • Global Open Entry: The Competition is open to individuals globally. However, entries are void in any jurisdiction or region where the Promoter cannot legally, safely, or logistically ship merchandise from Australia.
  • Exclusions: Staff, executives, contractors, and employees of Piyesa Hub Pty Ltd, alongside members of their immediate families (parents, spouses, siblings, children), are strictly prohibited from entering the Competition or claiming prizes across any tier.
  • No Purchase Necessary: Entry into this Competition is entirely free. No financial transaction or purchase of any goods is required to enter, qualify, or win the Grand Prize or a Second Prize. Making a purchase will not improve an entrant's chances of selection.

3. Intellectual Property (IP) Rights & Product Manufacture

By submitting an original product design to this Competition, each entrant explicitly accepts and agrees to the following legally binding intellectual property terms:

  • Assignment of Ownership: Upon submission of an entry, the entrant completely, exclusively, and perpetually assigns, transfers, and conveys all intellectual property (IP) rights, title, trademarks, utility models, and interest in and to the submitted design product to Piyesa Hub Pty Ltd.
  • Commercial Manufacturing Rights: Piyesa Hub Pty Ltd retains the absolute and unilateral right to manufacture, mass-produce, distribute, advertise, market, and commercially sell any submitted design, version, or adaptation of the product worldwide.
  • Waiver of Ongoing Compensation: In the event that Piyesa Hub Pty Ltd manufactures and sells a product derived from or identical to an entrant's submission, the Promoter is under no obligation to pay the entrant any royalties, residuals, licensing fees, equity, or ongoing financial compensation. The entrant's sole entitlement to compensation remains restricted strictly to the defined prizes and participation incentives outlined in Sections 4 and 6 of these Terms.

4. Competition Structure & Winner Selection

4.1 Grand Prize

  • The Prize: Exactly one (1) Grand Prize winner will receive one (1) complete EK 290mm fender set with an estimated Recommended Retail Price (RRP) of A$2,099.
  • Shipping & Logistical Costs: The Grand Prize includes complementary worldwide shipping handled by the Promoter. However, any localized customs duties, import tariffs, regional clearance taxes, or brokerage fees remain the sole financial obligation of, and must be paid by, the designated winner.
  • Shortlisting and Final Selection:
    • Following the close of the official public polling phase, the top ten (10) eligible designs securing the highest cumulative public vote counts will be placed on a definitive shortlist.
    • Piyesa Hub Pty Ltd will evaluate the shortlisted entries and select exactly one (1) definitive Grand Prize winner from that pool at its sole, absolute, and unreviewable discretion.

4.2 Second Prize (Guaranteed Free Set Tier)

  • The Qualifying Threshold: Any submitted design that successfully garners 150 or more verified, valid public votes will automatically qualify for consideration in this tier.
  • The Prize: Confirmed winners in this tier will receive a free EK 290mm fender set.
  • Prize Volume Cap: The distribution of Second Prizes is strictly capped at a maximum of three (3) sets in total. If more than three (3) distinct designs exceed the 150-vote threshold, Piyesa Hub Pty Ltd will select exactly three (3) final winners from the qualifying pool at its sole corporate discretion.
  • Shipping & Logistical Costs: Winners of the Second Prize must pay for all standard and expedited freight costs to their address, in addition to any relevant customs clearances, duties, and local taxes.

5. Vote Integrity & Limits

  • Vote Ceiling: There is no ceiling or restrictive cap placed on the total volume of legitimate votes an entrant can accumulate. Entrants are permitted and encouraged to promote their work to maximize public engagement.
  • Voting Limitations: Voting is strictly constrained to a maximum of one (1) vote per unique, signed-in, and authenticated email account.
  • Fraud Mitigation and Disqualification: Piyesa Hub Pty Ltd reserves the absolute right to audit voting traffic. The Promoter will invalidate any votes deemed to be fraudulent, automated, bot-driven, script-generated, bought, or manipulated. Any entry heavily linked to malicious voting behavior faces immediate disqualification at the Promoter's discretion.

6. All Entrants: Participation Rewards

6.1 First-Batch 20% Discount Code

All verified and eligible entrants will receive a promotional discount code granting a twenty percent (20%) deduction on a purchase from the initial production batch of the EK 290mm fender sets.

  • Validity Windows: The code must be redeemed within exactly four (4) weeks following the formal, announced closing date of the Competition.
  • Restrictions: The code applies exclusively to first-batch EK 290mm fender production runs, is strictly single-use per customer account, and cannot be stacked, merged, or combined with any other store credit, promotional offer, or seasonal discount code.

6.2 Post-Purchase UGC Reward (A$250 Store Credit)

Entrants who opt to purchase an EK 290mm fender set can qualify to receive a A$250 store credit by fulfilling the following User Generated Content (UGC) criteria:

  • Core Criteria: The customer must successfully purchase a fender set, successfully install the physical product on their personal vehicle, and share a clear, public photograph of the finished installation on an authorized social media platform.
  • Submission Window: The public social media post must be uploaded within six (6) weeks of the underlying product being officially delivered to the customer.
  • Tagging Obligation: The post must prominently and explicitly tag the official Piyesa Hub corporate social account.
  • Content Licensing: By claiming and accepting the subsequent store credit, the customer grants Piyesa Hub Pty Ltd an absolute, irrevocable, perpetual, worldwide, royalty-free license to redistribute, copy, publish, modify, and repurpose the complete post—inclusive of all high-resolution imagery and caption text—across any marketing, print, or digital media channels operated by the company.
  • Credit Specifications: The store credit is set at a value of A$250 and remains valid for deployment for precisely three (3) months from its day of formal issuance.

7. Regulatory, Legal & Compliance Disclaimers

  • Exempt Trade Promotion Status: Because entry into this Competition is entirely free of charge and completely independent of any purchasing obligations, this campaign is intended to function as an exempt trade promotion under standard Australian state and territory gaming legislation.
  • Jurisdictional Framework: This operational framework is subject to ongoing compliance checkouts by external legal counsel, considering the high-value retail threshold of the Grand Prize (A$2,099) and the complex legal requirements governing global consumer participation. The Promoter's counsel will verify all required state-by-state permit protocols, public disclosure terms, or formal government notification obligations required inside Australia.
  • Indemnity & Limitation of Liability: To the absolute maximum extent permitted under applicable consumer law, Piyesa Hub Pty Ltd, its directors, and affiliates shall not be held liable for any direct, indirect, punitive, or consequential loss, damage, property harm, or personal injury sustained by entrants or winners in connection with the execution of this promotion or the subsequent usage of the awarded prizes.
